1. Preamble & Acceptance of Terms
Welcome to INDIA Shopping ("Company", "We", "Us", or "Our"), operating through the domain https://indiashopping.shop. These Terms and Conditions constitute a legally binding agreement between you ("User", "Independent Associate", or "Direct Seller") and INDIA Shopping governing your access to and use of our e-commerce platform, physical joining packages, binary incentive programs, and related services.
By registering on our platform, purchasing a ₹1,249 Joining Package, or accessing associate privileges, you unequivocally represent that you have read, understood, and agreed to be bound by these Terms and our related policies.
2. Associate Eligibility & Registration
- Age & Citizenship: The applicant must be a citizen of the Republic of India and at least 18 years of age possessing contractual capacity under the Indian Contract Act, 1872.
- Free Registration: In full compliance with Rule 5(1)(b) of the Consumer Protection (Direct Selling) Rules, 2021, registration as an Independent Associate with INDIA Shopping is completely free of charge. No mandatory fee, entry charge, or periodic renewal fee is required to become an associate.
- KYC Verification: Associates must furnish authentic KYC credentials including Permanent Account Number (PAN), Aadhaar card, valid mobile number, and active bank account details for verification and payout processing.
- Independent Contractor Status: An Independent Associate is strictly an independent business contractor. Nothing in these Terms shall be construed as creating an employer-employee, master-servant, franchise, or joint-venture relationship.
3. Joining Package & Tangible Product Supply
All optional starter joining activations (₹1,249 package) are 100% backed by tangible, merchantable consumer products of equal or higher commercial value. Upon activation, the associate chooses one physical product from our inventory:
Products are shipped directly to the member's registered address via our authorized national logistics network with tracking support.
4. Compensation Plan & Business Volume (BV) Rules
- Sales-Driven Compensation: All incentive commissions, pair matching bonuses, spillover rewards, and royalty turnover distributions are strictly calculated based on the successful retail sale and distribution of tangible goods.
- No Payment for Recruitment: In accordance with Indian direct selling laws, no compensation or financial reward is paid solely for the act of recruiting new members.
- 1:1 Binary Matching: Payout calculations are performed based on a 1:1 business volume (BV) match between the Left Leg and Right Leg downline teams.
- Tax Deductions (TDS): All incentives and commission disbursements are subject to applicable Tax Deducted at Source (TDS) under Section 194H of the Indian Income Tax Act, 1961, and administrative processing deductions.
5. Code of Ethics & Prohibited Conduct
Independent Associates must strictly adhere to professional direct selling ethics. The following activities are strictly prohibited and will result in immediate account termination with forfeiture of unpaid benefits:
- Making exaggerated, misleading, or guaranteed financial return claims about INDIA Shopping business opportunities.
- Operating or promoting any unauthorized pyramid scheme, chit fund, or money circulation scheme.
- Cross-sponsoring, poaching, or soliciting active associates belonging to other genealogy downlines.
- Publishing defamatory, false, or derogatory statements against the Company, its directors, or associates on social media or public forums.
6. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India. Any dispute, claim, or controversy arising out of or relating to this agreement shall be subject to amicable mutual conciliation, failing which exclusive jurisdiction shall vest in the competent civil courts at Bilaspur / Chhattisgarh / New Delhi.
